Hukuk Dairesi 2015\/6244 Esas ve 2016\/2299 numaral\u0131 karar ile cam balkon hakk\u0131nda emsal karar a\u00e7\u0131kland\u0131. Emsal karar \u015fu \u015fekilde:<br \/>\nTemyiz isteminin s\u00fcresi i\u00e7inde oldu\u011fu anla\u015f\u0131ld\u0131ktan sonra dosyadaki b\u00fct\u00fcn ka\u011f\u0131tlar okunup gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<br \/>\nDavac\u0131 vekili dava dilek\u00e7esinde, daval\u0131ya ait 42 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmde projeye ayk\u0131r\u0131 olarak kapat\u0131lan a\u00e7\u0131k balkonun eski hale getirilmesini istemi\u015f, mahkemece davan\u0131n reddine karar verilmi\u015ftir.<br \/>\n634 say\u0131l\u0131 Kat M\u00fclkiyeti Yasas\u0131&#8217;n\u0131n 19.maddesinin birinci f\u0131kras\u0131nda kat maliklerinin ana ta\u015f\u0131nmaz\u0131n mimari durumunu titizlikle korumaya mecbur olduklar\u0131 belirtildikten sonra ikinci f\u0131krada da kat maliklerinden birinin b\u00fct\u00fcn kat maliklerinin be\u015fte d\u00f6rd\u00fcn\u00fcn yaz\u0131l\u0131 r\u0131zas\u0131 olmad\u0131k\u00e7a ana ta\u015f\u0131nmaz\u0131n ortak yerlerinde in\u015faat, onar\u0131m, tesis ve de\u011fi\u015fiklik yapt\u0131ramayaca\u011f\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.Dosya i\u00e7erisindeki bilgi ve belgelerden, \u00f6zellikle bilirki\u015fi raporu i\u00e7eri\u011finden;
