Mahkeme ise davay\u0131 reddetmi\u015ftir. 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu\u2019nun 19. maddesinin birinci f\u0131kras\u0131nda, kat maliklerinin binan\u0131n mimari yap\u0131s\u0131n\u0131 titizlikle korumakla y\u00fck\u00fcml\u00fc olduklar\u0131 vurgulanm\u0131\u015ft\u0131r. \u0130kinci f\u0131krada ise, kat maliklerinden birinin, di\u011ferlerinin be\u015fte d\u00f6rd\u00fcn\u00fcn yaz\u0131l\u0131 r\u0131zas\u0131 olmadan, ortak alanlarda herhangi bir in\u015faat, onar\u0131m veya de\u011fi\u015fiklik yapamayaca\u011f\u0131 belirtilmektedir.<br \/>\nRIZASI OLMADAN YAPILAMAZ<br \/>\nDosya i\u00e7erisinde yer alan bilgi ve belgelerden, \u00f6zellikle bilirki\u015fi raporundan, daval\u0131ya ait ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmdeki mutfakla ba\u011flant\u0131l\u0131 balkonun, mutfakla birle\u015fecek \u015fekilde kapat\u0131ld\u0131\u011f\u0131 ve balkonun PVC malzemeyle kapat\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Bu t\u00fcr bir de\u011fi\u015fiklik, Yarg\u0131tay uygulamalar\u0131na g\u00f6re sabit bir eser niteli\u011fi ta\u015f\u0131d\u0131\u011f\u0131 i\u00e7in, di\u011fer kat maliklerinin be\u015fte d\u00f6rd\u00fcn\u00fcn yaz\u0131l\u0131 onay\u0131 olmadan ger\u00e7ekle\u015ftirilemez.
