Dava s\u00fcrecinde ilk olarak idare mahkemesi ba\u015fvuruyu reddetti. Ard\u0131ndan istinaf incelemesini yapan b\u00f6lge idare mahkemesi de ayn\u0131 y\u00f6nde karar verdi. Ancak s\u00fcre\u00e7 burada sona ermedi.<\/p>\n<p>Ba\u015fvuru bu kez Anayasa Mahkemesi \u00f6n\u00fcne ta\u015f\u0131nd\u0131. Y\u00fcksek Mahkeme\u2019nin dosyay\u0131 usulden reddetmek yerine \u201cesastan g\u00f6r\u00fc\u015fme\u201d karar\u0131 vermesi dikkat \u00e7ekti. Hukuk \u00e7evreleri, bu karar\u0131n ba\u015fvurunun ciddi bulundu\u011fu anlam\u0131na geldi\u011fini de\u011ferlendiriyor.<\/p>\n<p>Davay\u0131 yak\u0131ndan takip edenlere g\u00f6re olas\u0131 bir hak ihlali karar\u0131 halinde emekli memurlar i\u00e7in \u00f6nemli mali sonu\u00e7lar do\u011fabilir. Hesaplamalara g\u00f6re, seyyanen zamm\u0131n emeklilere de uygulanmas\u0131 durumunda ki\u015fi ba\u015f\u0131na olu\u015fabilecek hak kayb\u0131 yakla\u015f\u0131k 524 bin 537 TL\u2019ye kadar ula\u015f\u0131yor.
