Bizden &ouml;nceki d&ouml;nemlerde haks\u0131z, adaletsiz bir bi&ccedil;imde yap\u0131lan kesintilere hakl\u0131 olarak itiraz eden bir vatanda\u015f\u0131m\u0131z\u0131n mahkemeye ba\u015fvurmas\u0131yla bu sonu&ccedil;lar do\u011fmu\u015ftur. Zaman\u0131nda &ouml;yle kesintiler yap\u0131lm\u0131\u015f ki sonucun bu \u015fekilde olmas\u0131 ka&ccedil;\u0131n\u0131lmazd\u0131r. Birinden  60 kesip di\u011ferine dokunmaz, haks\u0131z bir uygulama yaparsan\u0131z bu nihayetinde kar\u015f\u0131n\u0131za &ccedil;\u0131kar.<\/span><\/span><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p dir=\"ltr\" style=\"text-align:justify\"><span style=\"font-family:tahoma,geneva,sans-serif\"><span style=\"font-size:22px\"><span style=\"color:#000000\"><span style=\"background-color:transparent\">Sar\u0131&ccedil;am Mahallesi&rsquo;nin m&uuml;lkiyet durumunun baz\u0131 mahallerde de oldu\u011fu gibi tarla sahipleri ve emlak&ccedil;\u0131lar\u0131n zaman\u0131nda vatanda\u015flara hisseli olarak satt\u0131\u011f\u0131 hisselerde yol, ye\u015fil alan, okul, cami gibi sosyal donat\u0131 alan\u0131 paylar\u0131n\u0131n da i&ccedil;erisinde bulundu\u011fu bir durumla olu\u015ftu\u011funu dile getiren Ba\u015fkan &Ccedil;elikcan &ldquo;Vatanda\u015flar\u0131m\u0131z bu hisseli tapulara g&ouml;re arazileri &ccedil;evirmi\u015f ve &ccedil;o\u011funlu\u011fu ruhsats\u0131z olarak i&ccedil;erisine evlerini in\u015fa etmi\u015flerdir. Vatanda\u015flar\u0131n bu &ccedil;ok hisseli ve i&ccedil;erisinde yol, ye\u015fil alan, okul, cami gibi sosyal donat\u0131 paylar\u0131 da d&acirc;hil olan tapular\u0131n\u0131 imarl\u0131 hale getirebilmek i&ccedil;in Y&uuml;re\u011fir Belediye Enc&uuml;meni&rsquo;nin 23.12.1999 tarih ve 4174 say\u0131l\u0131 karar\u0131 ile imar d&uuml;zenlemesi yap\u0131lm\u0131\u015ft\u0131r. \u0130mar d&uuml;zenlemesi Y&uuml;re\u011fir Tapu M&uuml;d&uuml;rl&uuml;\u011f&uuml; taraf\u0131ndan 19.06.2000 tarih ve 3825 nolu yevmiye ile imarl\u0131 arsa vasf\u0131nda tapu olarak tescil edilmi\u015ftir.<\/span><\/span><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p dir=\"ltr\" style=\"text-align:justify\"><span style=\"font-family:tahoma,geneva,sans-serif\"><span style=\"font-size:22px\"><span style=\"color:#000000\"><strong>HER M&Uuml;LK\u0130YET SAH\u0130B\u0130NDEN E\u015e\u0130T KES\u0130NT\u0130<\/strong><\/span><\/span><\/span><\/p>\n<p dir=\"ltr\" style=\"text-align:justify\"><span style=\"font-family:tahoma,geneva,sans-serif\"><span style=\"font-size:22px\"><span style=\"color:#000000\"><span style=\"background-color:transparent\">2000 y\u0131l\u0131nda bir m&uuml;lkiyet sahibinin yap\u0131lan bu imar d&uuml;zenlemesine itiraz ederek Adana 2. \u0130dare Mahkemesi&rsquo;ne ba\u015fvurdu\u011funu belirten Ba\u015fkan &Ccedil;elikcan, &ldquo;Vatanda\u015f\u0131m\u0131z mahkemeden her m&uuml;lkiyet sahibinden e\u015fit oranda DOP kesilmesini talep etmi\u015f, kendisinden yasal mevzuatta yer alan her m&uuml;lkiyet sahibinden en fazla  35 DOP kesilmesi gerekirken  59 oran\u0131nda kesinti uyguland\u0131\u011f\u0131n\u0131 iddia ederek imar d&uuml;zenlemesinin iptalini istemi\u015ftir. Adana 2. \u0130dare Mahkemesi de 02.11.2001 tarihli ve 2000\/876 E.N. 2001\/1328 K.N. say\u0131l\u0131 karar ile imar d&uuml;zenlemesini iptal etmi\u015ftir. Adana 2. \u0130dare Mahkemesi&rsquo;nin karar\u0131 Dan\u0131\u015ftay 6. Dairenin 15.05.2003 tarihinde 2002\/763 E.N. 2003\/3086 K.N. say\u0131l\u0131 karar\u0131 ile onanm\u0131\u015ft\u0131r.<\/span><\/span><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p dir=\"ltr\" style=\"text-align:justify\"><span style=\"font-family:tahoma,geneva,sans-serif\"><span style=\"font-size:22px\"><span style=\"color:#000000\"><strong>&ldquo;D\u0130REKT BELED\u0130YEM\u0130Z\u0130N YAPTI\u011eI B\u0130R \u0130\u015eLEM DE\u011e\u0130L&rdquo;<\/strong><strong>&nbsp;&nbsp; &nbsp;<\/strong><\/span><\/span><\/span><\/p>\n<p dir=\"ltr\" style=\"text-align:justify\"><span style=\"font-family:tahoma,geneva,sans-serif\"><span style=\"font-size:22px\"><span style=\"color:#000000\"><span style=\"background-color:transparent\">Daha sonra dava a&ccedil;arak imar d&uuml;zenlemesini iptal ettiren vatanda\u015flar 2015 y\u0131l\u0131nda konuyu tekrar mahkeme konusu yaparak bu sefer tazminat davas\u0131 a&ccedil;m\u0131\u015flard\u0131r. Bu a\u015famada Belediyemiz yukar\u0131da bahsi ge&ccedil;en Adana 2. \u0130dare Mahkemesi ve Dan\u0131\u015ftay kararlar\u0131ndan bilgi sahibi olmu\u015f ve hemen mahkeme kararlar\u0131n\u0131n uygulanmas\u0131 y&ouml;n&uuml;nde yeniden imar d&uuml;zenleme &ccedil;al\u0131\u015fmas\u0131 ba\u015flatm\u0131\u015ft\u0131r. Yeni yap\u0131lan imar d&uuml;zenlemesinde her m&uuml;lkiyet sahibinden yasal mevzuata ve mahkeme kararlar\u0131na g&ouml;re e\u015fit oranda DOP kesintisi yap\u0131lm\u0131\u015f ve Y&uuml;re\u011fir Tapu M&uuml;d&uuml;rl&uuml;\u011f&uuml; taraf\u0131ndan 28.06.2017 tarih ve 11538 yevmiye numaras\u0131 ile yeni tapular tescil edilmi\u015ftir.
